The Real Estate Regulatory Authority (Rajasthan) proposal to constitute permanent appellate tribunal is expected to get the Election Commission (EC) steering committee nod The urban development and housing (UDH) department will soon invite applications across the country to constitute RERA, authority and appellate tribunal. After the model code of conduct came into effect as per mandatory provision the proposal was forwarded to EC to constitute RERA, authority and appellate tribunal. A senior UDH official informed, the department has already constituted three member committee to select tribunal member. The committee would nominate authority and appellate tribunal. Sources said, earlier to avoid financial burden, the RERA has decided not to set up a permanent appellate tribunal. We proposed that tribunal set up for food safety can also hear RERA cases Setting up a full-fledged appellate tribunal could be an additional financial burden. However, as per the act is is mandatory to have an independent appellate and decision was taken in this regard, It was said as per the mandatory provision; the developers have to register themselves on RERA website.
Once details of all the ongoing projects are uploaded on the website, the aggrieved consumers can register their complaints at RERA office. The RERA has been introduced with an aim to bring more transparency in the existing system and protect the interest of home buyers. It was said an appellate tribunal was set up to adjudicate disputes. Official said, in Rajasthan, the RERA, has strictly acted against the defaulters and disposing the complaints without a delay. Recently, action against two developers who failed to provide possession of properties to the consumers. For the first time in the country, RERA had also directed the developers to pay Rs 50,000 compensation to the buyers along with the penalty and interest on the booking amount. The action was taken after the developers failed to deliver the properties in a given timeframe. A senior RERA official said, We have directed the defaulter developers to pay 8.45% interest on the amount deposited by the buyers. An additional 2% penalty has also been imposed as per the Real Estate Regulation and Development Act 2016. We have also directed the developer to pay Rs 50,000 penalty to the consumers, the official said. Official said, consumers who are facing similar problems can register their complaints on rera.rajasthan.gov.in
