The Haryana Real Estate Regulatory Authority (H-Rera) has directed a Gurgaon-based realty company to refund the amount taken from the buyers of a housing project for not handing over the possession of the units on time. It is a clear cut case of cheating/fraud where buyers had been hoodwinked by glossy brochures and advertisements in the newspapers, observed the bench headed by Khandelwal. Hearing the parties, the H-Rera bench ordered that the money received by the respondent from the complainant by way of advance is ordered to be refunded along with interest at the rate 10.45% per annum as he has cheated/defrauded the innocent buyers. Bench has also set a deadline of 90 days for refunding the amount.
